The selling process

In NSW, your agent will require a contract to commence advertising your property. The agent will discuss whether you wish to sell by private treaty (advertise online for a set price or price range) or by auction. We will prepare the contract in accordance with your instructions and will provide your real estate agent with a copy of the marketing contract in approximately 2 to 3 working days, sometimes sooner.

Once the parties have negotiated the sale price, the contracts will either exchange with the real estate agent, or the parties’ representatives. Residential properties are exchanged with a 5-day cooling off period unless a certificate is provided upon request to waive the cooling off period. Once the matter has cooled off or exchanged without any conditions, the full deposit is paid and the parties are bound to settle the contract.

Between exchange and settlement you will need to vacate the property, if the property is your primary residence, arrange for a removalist and disconnection of services. Our office will communicate with your lender (if applicable) to book in your settlement and provide you with settlement figures to review and approve.
Assisting you with your sale
Hive Conveyancing will assist you at each stage and ensure your property transaction will be handled with care and attention.

We will assist with the discharge of mortgage instructions for your lender (if you have a loan) and ensure your lender will be ready to settle and discharge the mortgage.

If you are purchasing at the same time, and require your sale and purchase matter to settle simultaneously, we will work with all parties to arrange an on-time settlement.
We can co-ordinate both of your matters, no matter where your properties are located in New South Wales, to settle at the same time or as close as possible.
Whether you are selling interstate and purchasing in New South Wales, selling in New South Wales and purchasing interstate, whilst we cannot assist with your interstate transaction, we will liaise with your legal representative to ensure the flow of funds are available when you are required to settle.
